WASHINGTON, DC– Mayor Vincent C. Gray and Attorney General Irvin B. Nathan today praised the decision issued by the U.S. Court of Appeals for the D.C. Circuit today sustaining the constitutionality of the Patient Protection and Affordable Care Act (ACA) passed by Congress and signed into law by President Obama in 2010.

In this case, the District of Columbia Office of the Attorney General joined a brief filed by the state of Maryland on behalf of a number of states and the District arguing that the ACA represents an appropriate use of federal power to address the nation’s healthcare crisis and to achieve a more rational, market-based system for paying for health care goods and services.

Mayor Gray said, “The decision by the Court of Appeals appropriately recognizes the importance of this legislation to the welfare of our citizens and those throughout our nation and the important protections it provides to the health care system nationally.”

The brief noted that incentives in the ACA will expand the number of employers who offer insurance to their workers, which is the principal private mechanism for healthcare financing, and that many of the District’s 9,700 eligible small businesses already have started taking advantage of incentives created in the federal law.

AG Nathan added, “ I hope the Supreme Court notes the powerful logic of the DC Court’s ruling, written by one of its most conservative members.”
