 MPD-Request for ReconsiderationMPD provided all the requested documents therefore the appeal was rendered moot and thereby dismissed. DMH-Requesting More InformationDMH withheld addresses of mental health facilities citing exemption 2. The Mayor’s office determined the address of a mental health facility does not fall under the definition of mental health information. Office of the Secretary, Requesting More InformationBased on mutually agreed upon search terms the Office of the Secretary produced relevant documents. The requester did not receive the documents desired and appealed requesting a search with broader terms. This constitutes a new search and this appeal is thereby dismissed. OTR- Request for a ResponseRequester wanted records explaining why his property taxes increased and the names of all persons involved. Requester received a list of vacant properties but no names. The request was remanded in part to get the requester a list of names and dismissed in part. OPC, Exemption 3Exemption 3 is inapplicable and OPC ordered to provide requester will all documents except those specifically excluded in the opinion. MPD-Request for a ResponseRequest has moved to the Superior Court for litigation and is therefore held in abeyance until the litigation is resolved. DMPED-Denial Under Exemption 1Requester appeals because they believe DMPED misapplied DC FOIA exemption 1. The Mayor’s office upheld the denial under exemption 1 because releasing the information would cause substantial harm to the competitive position of the entity submitting the proposal. MPD, Request for ResponseInitially MPD denied the request because the agency misunderstood what was being requested. MPD later realized their mistake and denied part of the request under exemption 2. WASA, Documents Possessed by a Third PartyAppeal dismissed because WASA’s position is reasonable and without direct evidence to the contrary the Mayor’s office saw no reason to undercut their position on appeal.
